- § 4
Klient otrzymuje Regulamin przed zawarciem umowy i wpłatą zadatku, w formie umożliwiającej jego zapisanie i późniejsze odtworzenie.
- § 5
Regulamin nie wymaga podpisu Klienta. Wpłata zadatku po otrzymaniu Regulaminu oraz potwierdzenie rezerwacji oznaczają zawarcie umowy i akceptację Regulaminu.
- § 6
REZERWACJA, CENA I ZADATEK
- § 7
Wstępnej rezerwacji można dokonać za pośrednictwem poczty elektronicznej, Instagrama lub innego uzgodnionego kanału komunikacji.
- § 8
Rezerwacja zostaje potwierdzona po:
- a)uzgodnieniu terminu, miejsca wykonania tatuażu, ogólnego zakresu projektu i przewidywanego sposobu rozliczenia;
- b)przekazaniu Klientowi Regulaminu;
- c)wpłaceniu zadatku w wysokości 300 zł w terminie wskazanym przez Usługodawcę.

- § 10
- § 14
Pozostała część ceny płatna jest po zakończeniu sesji, gotówką albo inną formą płatności uzgodnioną przed sesją. Klient otrzymuje wymagany przepisami dowód płatności.
ODWOŁANIE I ZMIANA TERMINU
- § 15
- a)odwołania sesji na mniej niż 7 pełnych dni przed jej rozpoczęciem;
- b)niepojawienia się Klienta na sesji;
- c)kolejnej zmiany terminu;
- d)rezygnacji zgłoszonej od 7 do 13 pełnych dni przed sesją bez skorzystania z możliwości jednokrotnego przełożenia terminu.
- § 19
STAN ZDROWIA I PRZYGOTOWANIE SKÓRY
- § 30
- § 33
Klient zobowiązany jest przyjść na sesję trzeźwy i niepozostający pod wpływem narkotyków, substancji psychoaktywnych ani środków ograniczających zdolność świadomego podjęcia decyzji.
- § 34
Skóra w miejscu wykonywania tatuażu powinna być czysta, zdrowa, nieopalona i niepodrażniona. W szczególności nie może być:
- a)świeżo lub intensywnie opalona;
- b)poparzona słońcem;
- c)zaczerwieniona, podrażniona lub objęta aktywnym stanem zapalnym;
- d)uszkodzona, zraniona albo objęta infekcją;
- e)pokryta wysypką, aktywnymi zmianami skórnymi lub innymi zmianami uniemożliwiającymi bezpieczne wykonanie tatuażu.
- § 35
PROJEKT TATUAŻU I PRAWA AUTORSKIE
- § 38
- § 44
Ze względu na anatomię, właściwości skóry i technikę wykonywania tatuażu mogą wystąpić niewielkie i nieuniknione różnice pomiędzy projektem cyfrowym a wykonanym tatuażem.
- § 45
Tatuażysta może odmówić dokładnego kopiowania projektu innego twórcy.
- § 46
Jeżeli przygotowany projekt spełnia przesłanki utworu w rozumieniu prawa autorskiego, autorskie prawa osobiste i majątkowe do projektu przysługują jego twórcy, chyba że strony zawarły odrębną pisemną umowę stanowiącą inaczej.
- § 47
PRZEBIEG SESJI I ZASADY W MIEJSCU PRACY
- § 53
Tatuażysta stosuje procedury higieniczne i zapobiegania zakażeniom, używa sterylnych, jednorazowych igieł lub kartridży oraz odpowiednio zabezpiecza i dezynfekuje stanowisko pracy.
- § 54
GOJENIE I BEZPŁATNA KOREKTA
- § 61
Po wykonaniu tatuażu Klient otrzymuje zalecenia dotyczące pielęgnacji i gojenia. Klient zobowiązany jest ich przestrzegać.
- § 62
- § 64
Zgłoszenie powinno nastąpić po pełnym wygojeniu tatuażu i zawierać wyraźne fotografie oraz opis zauważonego problemu.
- § 65
Bezpłatna korekta przysługuje, jeżeli:
- a)jest potrzebna z powodu ubytku lub nierównomiernego utrwalenia pigmentu pozostającego w związku ze sposobem wykonania tatuażu;
- b)Klient przestrzegał przekazanych zaleceń dotyczących gojenia;
- § 67
Bezpłatna korekta nie obejmuje:
- a)zmiany koncepcji, wielkości lub kompozycji projektu;
- b)dodawania nowych elementów;
- c)zmian wynikających z nieprawidłowej pielęgnacji, opalania, urazu lub ingerencji innej osoby;
ODPOWIEDZIALNOŚĆ I REKLAMACJE

- § 76

SERVICE PROVIDER DETAILS AND GENERAL PROVISIONS
- § 1
The Service Provider is ILYA LISOUSKI, running a sole proprietorship under the business name ILYA LISOUSKI, NIP (tax ID): 1133197597, REGON: 544284105, business and correspondence address: Nowogrodzka 6A/35, e-mail: molekulartattoo@gmail.com, Instagram: @ilya_lisouski_, hereinafter the “Service Provider”. The person performing the tattoo is hereinafter the “Tattoo Artist”. Where the Service Provider and the Tattoo Artist are the same person, these terms may be used interchangeably.
- § 2
These Terms set out the rules for booking, preparing and performing tattoo services, payment, rescheduling, touch-ups, complaints, and the taking and publishing of photos and video recordings.
- § 3
Services are provided only to persons who are at least 18 years old and have full legal capacity. The Tattoo Artist may ask for an identity document confirming age.
- § 4
The Client receives these Terms before the contract is concluded and the deposit is paid, in a form that allows them to be saved and accessed later.
- § 5
These Terms do not require the Client’s signature. Paying the deposit after receiving these Terms and confirmation of the booking constitute conclusion of the contract and acceptance of these Terms.
- § 6
Individual arrangements confirmed by both parties by e-mail or text message take precedence over these Terms, to the extent they do not violate mandatory provisions of law.
BOOKING, PRICE AND DEPOSIT
- § 7
A preliminary booking can be made by e-mail, Instagram or another agreed communication channel.
- § 8
A booking is confirmed once:
- a)the date, placement of the tattoo, general scope of the design and expected method of payment have been agreed;
- b)the Client has been provided with these Terms;
- c)a deposit of PLN 300 has been paid within the time specified by the Service Provider.
- § 9
Where several separate sessions are booked, a deposit is charged for each booked session.
- § 10
If the service is performed, the deposit is credited towards its price.
- § 11
The price is set individually, in particular based on the size, complexity and placement of the design and the expected working time.
- § 12
The price or day rate is communicated to the Client before the booking is confirmed. Any later change requires the Client’s agreement and may result in particular from a change in the size, placement or scope of the design at the Client’s request.
- § 13
For larger projects, the number of sessions required is an estimate, unless the parties have expressly agreed otherwise.
- § 14
The remaining part of the price is payable after the session, in cash or by another payment method agreed before the session. The Client receives proof of payment as required by law.
CANCELLATION AND RESCHEDULING
- § 15
The Client may cancel a session at least 14 full calendar days before it begins. In that case the deposit will be refunded within 14 days of receiving clear notice of the cancellation.
- § 16
The Client may reschedule once without losing the deposit, provided they notify the Service Provider at least 7 full calendar days before the session begins.
- § 17
The new date should be no later than 60 days after the original date, subject to the Tattoo Artist’s availability. If the Tattoo Artist has no available date within that period, they will offer the earliest possible date.
- § 18
The Service Provider may withdraw from the contract and retain the deposit, subject to mandatory provisions of law, in the event of:
- a)cancellation of the session less than 7 full days before it begins;
- b)the Client’s failure to attend the session;
- c)a further change of date;
- d)cancellation made between 7 and 13 full days before the session without using the option to reschedule once.
- § 19
Arriving late does not automatically extend the session. If the Client’s lateness prevents the agreed scope of work from being carried out safely or properly, the Tattoo Artist may reschedule or cancel the session. If the lateness is the Client’s fault, a new deposit may be required.
- § 20
The Client should report a sudden illness, accident or other extraordinary event without delay. The Service Provider may ask for reliable confirmation of the event, without the Client having to disclose a medical diagnosis. The parties will first try to agree on a new date.
- § 21
If the contract is not performed for reasons for which neither party is responsible, or for which both parties are responsible, the deposit is refunded in accordance with Article 394 § 3 of the Polish Civil Code.
- § 22
The Tattoo Artist may change the date due to illness, equipment failure, an unexpected event or another important reason that prevents the service from being performed safely. The Client will be informed without delay and may choose a new date or settlement of the deposit in accordance with applicable law.
- § 23
If the contract is ultimately not performed for reasons for which the Service Provider is responsible, the consequences regarding the deposit set out in Article 394 of the Polish Civil Code apply, including — after effective withdrawal by the Client — the right to demand double the amount.
DISTANCE CONTRACTS
- § 24
If the contract with the Client was concluded at a distance, in particular via the Internet, e-mail or social media, the Client generally has the right to withdraw from the contract within 14 days of its conclusion without giving any reason.
- § 25
A statement of withdrawal may be sent to molekulartattoo@gmail.com. A clear statement of withdrawal from the contract is sufficient. The Client may, but does not have to, use the model form in Appendix No. 1.
- § 26
Effective exercise of the statutory right of withdrawal takes precedence over the provisions of these Terms on retaining the deposit.
- § 27
If the Client wants performance of the service, including preparation of an individual design, to begin before the 14-day withdrawal period expires, they must make a separate, express request to that effect.
- § 28
If the Client withdraws from the contract after performance has begun at their express request, they may be required to pay a proportionate part of the fee for the service provided up to the moment of withdrawal.
- § 29
Once the service has been fully performed, the Client loses the right of withdrawal if performance began with their prior express consent and after they acknowledged that they would lose the right of withdrawal once the service was fully performed.
HEALTH AND SKIN PREPARATION
- § 30
Before the session the Client must truthfully complete an informed consent form for the tattoo and a questionnaire on contraindications.
- § 31
The Client should inform the Tattoo Artist of any circumstances known to them that may affect the safety of the procedure, blood clotting, healing or the possibility of an allergic reaction.
- § 32
The Tattoo Artist does not make medical diagnoses. If in doubt, the Client should consult a doctor about whether the tattoo can be done. The Client should not stop taking medication prescribed by a doctor on their own.
- § 33
The Client must come to the session sober and not under the influence of drugs, psychoactive substances or any substances that limit their ability to make an informed decision.
- § 34
The skin in the area to be tattooed should be clean, healthy, untanned and not irritated. In particular, it must not be:
- a)freshly or heavily tanned;
- b)sunburnt;
- c)red, irritated or affected by active inflammation;
- d)damaged, wounded or infected;
- e)covered with a rash, active skin lesions or other changes that prevent the tattoo from being done safely.
- § 35
The Tattoo Artist has the right to refuse to start or to stop the service if the condition of the Client or their skin may pose a risk to health or safety or to the proper performance of the tattoo.
- § 36
If the refusal or rescheduling of the session results from failure to follow previously provided instructions, in particular deliberate tanning, concealing relevant information or arriving under the influence of intoxicating substances, the service is deemed not to have been performed for reasons attributable to the Client. In such a case the Service Provider may withdraw from the contract and retain the deposit.
- § 37
If the contraindication is not the result of the Client’s action or negligence, the parties will agree a new date or settle in accordance with applicable law.
TATTOO DESIGN AND COPYRIGHT
- § 38
The design is generally presented to the Client the day before the session, unless the parties have agreed otherwise.
- § 39
A consultation on the design is possible by prior appointment.
- § 40
Minor changes can be made before the session or on the spot. A significant change of concept, style, subject, placement or size may require a new design, a change of price or rescheduling of the session.
- § 41
Before tattooing begins, the Client approves the design, its size and its placement on the body.
- § 42
By approving the design, the Client accepts its composition, style, symbolism, lettering, dates, numbers, colours and placement.
- § 43
The Client must check the spelling, dates, numbers and wording of any lettering. The Tattoo Artist is responsible for accurately reproducing the approved text but is not responsible for the correctness of a translation or the meaning of content supplied and approved by the Client.
- § 44
Due to anatomy, skin properties and tattooing technique, there may be minor and unavoidable differences between the digital design and the finished tattoo.
- § 45
The Tattoo Artist may refuse to make an exact copy of another artist’s design.
- § 46
If the prepared design qualifies as a work within the meaning of copyright law, the moral and economic copyrights in the design belong to its creator, unless the parties have concluded a separate written agreement stating otherwise.
- § 47
Payment for preparing and performing the tattoo does not transfer the economic copyrights in the design to the Client, nor does it grant the Client exclusivity over the motifs, stylistic elements, compositional or technical solutions used in it.
- § 48
The Tattoo Artist retains the right to reuse in other designs their own motifs, fragments, graphic elements, and stylistic, geometric, compositional and technical solutions previously used in a design prepared for the Client, provided they hold the relevant rights to them.
- § 49
Reuse of individual elements does not mean the right to make an identical copy of the entire individual composition for another person, unless the Client and the Tattoo Artist have expressly agreed otherwise.
- § 50
Without the Client’s separate consent, reuse does not include the Client’s likeness, portraits of people close to them, names, dates, personal data or any other elements that would identify the Client or are of a strictly personal nature to them.
- § 51
The right of reuse does not cover elements to which third parties hold the rights, unless their use is permitted under a licence, the consent of the rights holder or applicable law.
- § 52
The Client may photograph and publish the tattoo on their body for private, non-commercial purposes. However, without the creator’s consent they may not share the design file with another person for the purpose of copying the tattoo exactly, sell the design or use it commercially.
THE SESSION AND STUDIO RULES
- § 53
The Tattoo Artist follows hygiene and infection-prevention procedures, uses sterile, single-use needles or cartridges, and properly protects and disinfects the workstation.
- § 54
The Client may not touch tools, working materials or the protected work area.
- § 55
Animals are not allowed, except for an assistance dog in accordance with applicable law. For sanitary reasons, its presence must be agreed in advance.
- § 56
A companion may be present only with the Tattoo Artist’s consent. The companion may not stay in the immediate work area or disrupt the session.
- § 57
The Client must obtain prior consent before photographing or filming the Tattoo Artist, other clients or the interior of the workplace.
- § 58
The Client must follow safety instructions and inform the Tattoo Artist if they feel unwell.
- § 59
If, after the session has begun, the Client decides not to continue for reasons attributable to them, payment is due for the part of the service performed and the time reserved, not exceeding the previously agreed price or day rate.
- § 60
The preceding point does not apply where the session is interrupted for reasons attributable to the Tattoo Artist or because it is necessary to protect the Client’s health, for which the Client is not responsible.
HEALING AND FREE TOUCH-UP
- § 61
After the tattoo is done, the Client receives aftercare and healing instructions. The Client must follow them.
- § 62
In the event of symptoms that may indicate infection, a severe allergic reaction or another complication, the Client should contact a doctor. Contact with the Tattoo Artist does not replace medical advice.
- § 63
The Client may request one free touch-up within 3 months from the date of the tattoo.
- § 64
The request should be made once the tattoo has fully healed and should include clear photos and a description of the problem noticed.
- § 65
A free touch-up is available if:
- a)it is needed because of pigment loss or uneven pigment retention related to the way the tattoo was performed;
- b)the Client followed the healing instructions provided;
- c)the tattoo has not been damaged, altered or reworked by another person.
- § 66
The date of an approved touch-up is set individually, after the skin has fully healed. To keep the entitlement, it is enough to request the touch-up within 3 months; the touch-up itself may take place later, on an agreed date.
- § 67
A free touch-up does not include:
- a)changes to the concept, size or composition of the design;
- b)adding new elements;
- c)changes resulting from improper aftercare, tanning, injury or interference by another person;
- d)natural changes in the tattoo resulting from the passage of time, skin properties or further changes in the body, unless they result from improper performance of the service.
- § 68
In case of doubt, whether a touch-up is justified is assessed on the basis of photos, the course of healing and, if necessary, an inspection of the tattoo. The Client may dispute a refusal of a touch-up through the complaints procedure.
- § 69
The free touch-up is an additional contractual entitlement and does not limit the Client’s statutory rights related to non-performance or improper performance of the service.
LIABILITY AND COMPLAINTS
- § 70
The Tattoo Artist is responsible for performing the service with due care and in accordance with the agreed design, taking into account the natural properties of the skin and the specific nature of the tattooing process.
- § 71
The Tattoo Artist is not liable for a deterioration of the result only to the extent that it is causally connected with:
- a)failure to follow aftercare instructions;
- b)the Client concealing relevant information;
- c)skin damage, tanning, infection, injury or interference by another person after the session.
- § 72
Nothing in these Terms excludes the liability of the Service Provider or the Tattoo Artist to the extent that such exclusion is not permitted under applicable law.
- § 73
A complaint can be submitted:
- a)by e-mail: molekulartattoo@gmail.com;
- b)in writing to: Nowogrodzka 6A/35;
- c)in any other legally permitted form that allows its content to be read.
- § 74
A complaint should, where possible, include the Client’s details, the date of the session, a description of the problem, the request and photos of the tattoo. The absence of any of these elements does not automatically result in the complaint being rejected.
- § 75
The Client will receive a response to the complaint within 14 days of its receipt, on paper or another durable medium.
- § 76
If the complaint is not upheld, the Client will be informed of the Service Provider’s position and whether the Service Provider agrees to take part in out-of-court consumer dispute resolution.
PHOTOS, RECORDINGS AND LIKENESS
- § 77
The Tattoo Artist may offer to take photos or video of the tattoo for documentation, portfolio presentation, online publication or advertising purposes.
- § 78
Publishing a photo or video of the tattoo, and in particular material showing the Client’s recognisable likeness, face, figure or voice, requires separate and voluntary consent.
- § 79
Consent to publication is not a condition of the service. Refusing to give it does not affect the price, the quality of the service, the possibility of making a complaint or the right to a free touch-up.
- § 80
The Client decides separately whether they consent to:
- a)publication of the tattoo alone or a part of the body without a recognisable face;
- b)publication of material showing their recognisable likeness, face, figure or voice;
- c)use of selected material in paid advertising campaigns, social media ads and sponsored posts.
- § 81
The scope of consent, publication channels, data processing rules and the method of withdrawing consent are set out in a separate form.
- § 82
The Client may withdraw consent to future use of the material at any time. Withdrawal of consent does not affect the lawfulness of actions taken before it was withdrawn.
PERSONAL DATA
- § 83
The rules for processing personal data, including contact details, booking data, the health questionnaire, complaints, and photos and recordings, are set out in a separate privacy notice provided to the Client before processing begins.
- § 84
The notice specifies in particular the data controller, the purposes and legal bases of processing, the recipients of the data, retention periods and the rights of the data subject.
- § 85
Health data is collected only to the extent necessary to assess whether the service can be performed safely and is processed on an appropriate legal basis.
FINAL PROVISIONS
- § 86

- § 87
Disputes are resolved by the competent court in accordance with applicable law. These Terms do not impose on the Client a court that would not be competent under the law.
- § 88
Amendments to these Terms do not affect bookings and contracts concluded before the amendments take effect, unless the change results from applicable law or is favourable to the Client.
- § 89
The invalidity or ineffectiveness of one provision does not affect the validity of the remaining provisions of these Terms.
- § 90
In the event of any discrepancy between the Polish version of these Terms and informational translations, the Polish version prevails, without prejudice to the Client’s rights under applicable law.
